Terms and Conditions for HomeWorx Ltd Home Improvement Services
1. General1.1 These Terms and Conditions ("Terms") govern the agreement between HomeWorx (Solihull) Ltd ("We," "Us," "Our") and the Customer ("You," "Your") for home improvement services. 1.2 By agreeing to these Terms, You confirm that You have read, understood, and accept them in full. 1.3 These Terms are governed by the laws of England and Wales.
2. Scope of Services2.1 We provide a range of services including bathroom and kitchen fitting, plastering, painting, flooring, and associated home improvement work. 2.2 We also offer services for insurance claims, including dealing with escape of water claims. 2.3 Our commercial work includes projects for businesses such as hairdressers and other commercial establishments. 2.4 The specific scope of work for Your project will be detailed in the quotation provided. 2.5 Any changes or additions to the scope of work must be agreed in writing and may result in additional charges.
3. Quotations and Contracts3.1 Any quotations provided are valid for 30 days unless otherwise stated. 3.2 A contract will be formed once You accept Our quotation and provide the initial payment as outlined in Section 5.
4. Materials4.1 All materials required for the project must be paid for in advance by You. 4.2 We will provide a detailed list of required materials for Your approval before purchase. 4.3 Any delays caused by the unavailability of materials will be communicated promptly. 4.4 Materials once purchased and delivered are non-refundable unless defective.
5. Payments5.1 Stage payments will be invoiced weekly based on the progress of the work. 5.2 Invoices must be paid upon receipt. 5.3 Failure to make timely payments may result in suspension of work until payment is received.
6. Access and Working Hours6.1 You must ensure safe and reasonable access to the worksite during Our agreed working hours. 6.2 Any restrictions to access must be communicated in advance.
7. Health and Safety7.1 We will comply with all relevant health and safety regulations while on Your premises. 7.2 You are responsible for ensuring that the worksite is free of hazards and accessible.
8. Delays and Force Majeure8.1 While We will make every effort to complete the project on time, delays may occur due to unforeseen circumstances. 8.2 Neither party shall be liable for delays caused by events beyond their reasonable control, including but not limited to natural disasters, strikes, or supplier disruptions.
9. Warranties and Liability9.1 We warrant that all work will be carried out with reasonable skill and care. 9.2 Our liability for any claim related to the work will not exceed the total amount paid under the contract. 9.3 We are not liable for issues arising from pre-existing structural or plumbing conditions unless expressly identified during the project.
10. Termination10.1 Either party may terminate the contract with written notice if the other party breaches a material term and fails to rectify it within 14 days of receiving notice. 10.2 In the event of termination, You will be invoiced for work completed up to the termination date.
11. Dispute Resolution11.1 Any disputes shall first be addressed through informal discussions between the parties. 11.2 If unresolved, disputes may be referred to mediation or arbitration in accordance with UK law.
12. Privacy and Data Protection12.1 Any personal data collected will be handled in accordance with applicable data protection laws.
